1. Acceptance of Terms

By creating an account, joining the waitlist, or otherwise accessing the Service, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them along with our Privacy Policy.

2. Description of Service

Moviq is a community platform that helps people discover nearby activities, communities, clubs, and events based on shared interests. The Service is currently in pre-launch. Features, availability, and pricing are subject to change without notice.

3. Accounts and Registration

When you register for an account or join the waitlist, you agree to provide accurate, current, and complete information; maintain the security of your credentials and not share them with others; notify us immediately of any unauthorized use of your account; and accept responsibility for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Acceptable Use

You agree not to use the Service to violate any applicable law or regulation; harass, threaten, or harm other users; post false, misleading, or deceptive content; scrape or extract data without permission; attempt to gain unauthorized access to any part of the Service; transmit spam, malware, or harmful code; or impersonate any person or entity.

5. User Content

You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant Moviq a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content solely for the purpose of operating and improving the Service. You are solely responsible for your User Content and represent that you have all rights necessary to grant the above license.

6. Intellectual Property

All content, trademarks, logos, and software comprising the Service (excluding User Content) are owned by or licensed to Moviq. Nothing in these Terms grants you any right to use Moviq's intellectual property without our prior written consent.

7. Third-Party Services

The Service may contain links to or integrations with third-party websites and services. Moviq is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MOVIQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOVIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MOVIQ IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

10. Indemnification

You agree to indemnify and hold harmless Moviq and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, all licenses granted to you under these Terms will immediately cease. Sections 5, 6, 8, 9, 10, and 13 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
